This website is operated by sole trader, Tanya Kelway. Throughout the site, the terms “we”, “us” “our” or “Mini Memento” refer to the sole trader ‘Tanya Kelway’. Tanya Kelway offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service. Any new features or tools which are added to the current store shall also be subject to the Terms of Service.

You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes. Our store is hosted on Wix.com. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

DESCRIPTIONS AND PRICING:

Image and descriptions on the website are representations of the final product, however, as each piece is unique, variations will occur. We try our hardest to show the true colours of certain products, such as the leather, but due to lighting, photography and variations in natural products, the colours may vary slightly.

When ordering a piece, you will be charged the amount shown on the product page on the date ordered. All prices include VAT. Mini Memento reserves the right to alter the prices of the products at their own discretion.

DELIVERY AND MAKING TIMES

Each piece is carefully handmade, and we ask you to check the making time for each piece before ordering. If you need the item quicker, please email us, but a faster delivery can not be guaranteed.

Print kits will be dispatched either the same day or 1 day after purchase. They will be sent first class royal mail so you should expect them within 3 days. If you have not received them after 7 days, please contact us. The jewellery is dispatched by Royal Mail Signed For, which usually takes 2 days, but can take 4. If you have not received your jewellery within 5 days of dispatch, please contact us. The tracking number is sent to you once the item is dispatched.

You can pay an extra £5 for Express postage - this will be sent recorded next day delivery, signed for.

International orders will take longer to arrive, but they are sent signed and tracked, so the progress can be checked on Royal Mail website.

For lost postal items, we are unable to refund or replace the item until 20 days for the UK and 30 days for international items as this is when Royal Mail classes the items as “lost”.

CANCELLATION

If you would like to cancel an order at Mini Memento, please contact us. If the cancellation is requested before a print kit is sent out, a full refund will be given. If the print kit has been sent, a refund minus the cost of the print kit will be given. Once we receive your prints, and we have started working on your piece of jewellery, then a refund will not be given.

Mini Memento reserves the right to cancel your order at any point, for reasons including, but not limited to, product or service availability, description or price errors or other reasons. We can not accept any liability for damage or loss resulting from such cancellation

GIFT VOUCHERS

Mini Memento gift vouchers are valid for 2 years.

Our gift vouchers are non-transferable, non-refundable, and can not be exchanged for cash. If the voucher is not redeemed in a single transaction, the outstanding amount will remain on the voucher until the expiry date. Additional payment will be required if the voucher value does not cover the cost of an order.

RETURNS

As each piece of Mini Memento jewellery is unique and made to the customer's specific requirements, items are non-refundable and returns are not possible unless their is a fault with the jewellery, or the wrong jewellery has been dispatched. If a fault has been found, please notify Mini Memento within 7 days of receiving the items, and we will sort the returns for you. Providing that we determine that an error on our part has occurred, then we will arrange for replacement goods at no additional cost to you.

Mini Memento does not accept any responsibility for any returned items which are lost, stolen or damaged in transit. This is the responsibility of the customer. When returning goods you should use a recorded delivery service which offers adequate insurance.

For overseas customers returning goods, if a customs declaration form is required, ensure you mark the goods as a 'Returned Item'. This will ensure that no additional customs fees are incurred. Should the item not be marked as a Returned Item and a customs fee incurred, this may be passed onto the customer.

Refunds will be issued 14 days after receiving the item.

REPAIRS

You have a 1 year guarantee with Mini Memento Jewellery from the purchase date. This guarantee does not extend to damage caused by obvious misuse, to lost or stolen goods, or to general wear and tear such as worn leather or surface scratches. If your jewellery needs repair after the year's guarantee, we can help you, but there will be an additional cost. Please contact us.

MODIFICATIONS TO THE SERVICE AND PRICES
Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

PRIVACY & ONLINE SECURITY

Your submission of personal information through the store is governed by our Privacy Policy. You acknowledge and agree to be bound by the terms of our service.

We do not store financial information like credit or debit card numbers on this site. All transactions are handled by a secure online independent payment service provider. We accept payment online by credit or debit card. Payment can also be made using Paypal.

Certain content, products and services available via our service may include materials from third-parties. Third-party links on this site may direct you to third-party websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy and we do not warrant and will not have any liability or responsibility for any third-party materials or websites, or for any other materials, products, or services of third-parties. We are not liable for any harm or damages related to the purchase or use of goods, services, resources, content, or any other transactions made in connection with any third-party websites. If, at our request, you send certain specific submissions (for example contest entries) or without a request from us you send creative ideas, suggestions, proposals, plans, or other materials, whether online, by email, by postal mail, or otherwise (collectively, 'comments'), you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments that you forward to us. We are and shall be under no obligation (1) to maintain any comments in confidence; (2) to pay compensation for any comments; or (3) to respond to any comments. We may, but have no obligation to, monitor, edit or remove content that we determine in our sole discretion is unlawful, offensive, threatening, libellous, defamatory, pornographic, obscene or otherwise objectionable or violates any party's intellectual property or these Terms of Service. You agree that your comments will not violate any right of any third-party, including copyright, trademark, privacy, personality or other personal or proprietary right. You further agree that your comments will not contain libellous or otherwise unlawful, abusive or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the service or any related website. You may not use a false e-mail address, pretend to be someone other than yourself, or otherwise mislead us or third-parties as to the origin of any comments. Occasionally there may be information on our site or in the service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order). We undertake no obligation to update, amend or clarify information in the service or on any related website, including without limitation, pricing information, except as required by law. No specified update or refresh date applied in the service or on any related website should be taken to indicate that all information in the service or on any related website has been modified or updated.

INTELLECTUAL PROPERTY

The service and its original content and features, are the exclusive property of Mini Memento, and may not be used without our consent. The service is protected by copyright, trademark, and other laws of the United Kingdom. Any artwork produced from customer prints are the property of Mini Memento. We reserve the right to use and display our artwork and to take photographs of our work for use on our site and other selling platforms. In submitting prints to us, you consent to this use, unless you expressly tell us otherwise.

INDEMNIFICATION

You agree to indemnify, defend and hold harmless Mini Memento and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY

We do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free. We do not warrant that the results that may be obtained from the use of the service will be accurate or reliable. You agree that from time to time we may remove the service for indefinite periods of time or cancel the service at any time, without notice to you. You expressly agree that your use of, or inability to use, the service is at your sole risk. The service and all products and services delivered to you through the service are (except as expressly stated by us) provided 'as is' and 'as available' for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.
